Notwet.pl on-line shop terms and conditions


These Terms and Conditions (hereinafter referred to as "Terms and Conditions") define the principles of using and making purchases at the notwet.pl on-line shop (hereinafter referred to as: Shop). Before starting to use the Shop, the User should acquaint themselves with the current wording of the Terms and Conditions.


  1. General information:
    1. The notwet.pl on-line shop is run by NOT WET Karolina Szewczykowska Paulina Wajdemajer-Wyrobek Spółka Cywilna with a registered office at: ul. Mokotowska 15a/1b, 00- 640 Warsaw, NIP (Tax ID No.): 7010580043, REGON (National Business Registry No.): 364559946 (hereinafter referred to as: "Notwet.pl" or "Service Provider")
    2. The Service Provider can be contacted quickly and effectively via e-mail: kontakt@notwet.pl.


  1. Definitions:
    1. Terms and Conditions -  these terms and conditions, made available in a form which enables its recording and reproducing as well as allows the User to acquaint themselves with it at any given time and place. In terms of services provided by electronic means, the Terms and Conditions are terms and conditions as referred to in Art. 8 of Act on Providing Services by Electronic Means of 18 July 2002 (Dz.U. [Journal of Laws] of 2002, No. 144, item 1204 as amended).
    2. Service Provider - entity defined in item 1 section 1 above;
    3. User – natural person of age with full capacity to perform acts in law, legal person or organisational entity without legal personality with capacity to perform acts in law, entering into agreement with the Service Provider, including a Consumer.  
    4. Consumer – User (as defined in Art. 221 of Civil Code) who is a natural person, performing through the Shop acts in law which are not directly connected with business or professional activity.
    5. Shop – on-line shop run by the Service Provider at www.notwet.pl, through which the User can make purchases of Products offered by the Service Provider.
    6. Product – goods offered by the Service Provider by means of the Shop.
    7. On-Demand Products - products that can be created upon request in accordance with User's specification, corresponding to their individual needs.


  1. Types and scope of the provided services as well as technical actions constituting the procedure of entering into an agreement
    1. User can use the Shop and enter into agreements with the Service Provider regarding Products and On-Demand Products based on the principles defined in the Terms and Conditions.  
    2. In regard to Products, User can enter into a distance selling agreement with the Service Provider using the Shop's Website. Detailed information on Products, including their prices, is available at appropriate webpages concerning individual products.
    3. In regard to On-Demand Products, User can enter into a distance agreement for specific task with the Service Provider, using the e-mail address: kontakt@notwet.pl. Detailed information about On-Demand Products, including the price of the On-Demand Product is agreed upon with the User after sending the request and before placing an order.
    4. In order to enter into the agreement defined in section 2 above, the User should:
      1. go to the Shop's Website,
      2. acquaint themselves with the Terms and Conditions,
      3. acquaint themselves with Products offered by the Service Provider and information about them made available on the webpages concerning the Products,
      4. choose Product(s) from the ones available in the Shop and add them to cart by clicking the button "ADD TO CART".
      5. fill in the order form, to which the User will be redirected after clicking the "ORDER" button, with their personal data and shipping address, and choose the payment method.
      6. accept Terms and Conditions by marking the appropriate check box;
      7. click the "Order and Pay" button.
    5. The agreement mentioned in section 2 above is concluded at the moment of placing the order by the User.
    6. After entering into the agreement in accordance with section 4 above, the User will receive an e-mail message containing a confirmation of entering into the agreement, the Terms and Conditions and a withdrawal from agreement form.
    7. In order to enter into the agreement mentioned in section 3 above (On-Demand Products), the User should:
  1. go to the Shop's Website,
  2. acquaint themselves with the Terms and Conditions,
  3. send an e-mail with the following information: shipping address, e-mail address, telephone number, order details (precise description of the ordered product, colour(s) and size)
  4. reply to the e-mail from the Service Provider which will contain the Terms and Conditions and a withdrawal from agreement form as well as information about the main features of the On-Demand Product, its price and the order completion time, and a reminder about the obligation to pay for the On-Demand Product.
    1. The agreement is concluded at the moment of replying to the message from the Service Provider mentioned in section 7d above.
    2. After entering into the agreement in accordance with section 7d above, the User will receive an e-mail from the Service Provider, containing the confirmation of entering into the agreement.


  1. Payment and order completion methods and deadlines
    1. User has the possibility to pay for the Products using one of the methods of payment below:
  1. payment by bank transfer to the Service Provider's bank account no. 97105010251000009226898303 within 3 days from placing the order in accordance with section 4 above.
  2. Payment using payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro using Shoplo – a quick payment system. The entity providing on-line payment services is Blue Media S.A. - http://www.bluemedia.pl.  
    1. If the User chooses the method of payment referred to in section 1a above, the payment should be made within 3 days from placing the order.
    2. If the User chooses the method of payment referred to in section 1b, the payment should be made within 48 hours from the date of purchase.
    3. The total price which the User is obliged to pay includes the price of all ordered Products and the cost of their shipping specified below.
    4. The User has the possibility to choose from among the following shipping methods for the ordered Products and On-Demand Products:
  1. Pre-paid DHL shipping: 20 PLN, delivery time: 1-3 days.
  2. Pre-paid personal collection: 0 PLN, personal collection: Monday – Friday 9:00 AM – 4:00 PM, ul. Mokotowska 15a/1b, 00-640 Warsaw.
    1. If the User orders more than one Product or On-Demand Product, the shipping cost is specified on the Website http://notwet.pl/strona/informacje.
    2. Orders for Products and On-Demand Products are shipped within the territory of Poland and all over the world after arranging it via e-mail: kontakt@notwet.pl.
    3. The Product order will be completed by the Service Provider within 3 days from placing the order in accordance with item 3 section 4g and making the payment in accordance with section 1b or 1c above, and in the case of choosing a method of payment defined in section 1a above, from the day the payment is credited to the Service Provider's bank account.
    4. The order for On-Demand Products will be completed by the Service Provider within the deadline indicated in the e-mail referred to in item 3 section 7d above, while the completion time will be calculated from the day the payment is credited to the Service Provider's bank account in accordance with item 1a above.
    5. The User will be informed about their order being processed and completed via an e-mail message sent to the User's e-mail address. Shipping time depends on the selected shipping method.

  1. Functionalities and interoperability with User's devices
  1. The Service Provider is an entity who places and accesses cookie files on the User's end device.
  2. Cookie files are used for the following purposes:
    - adapting the Website's content to the User's individual preferences; notably, these files recognize the User's device in order to display the Website in accordance with the User's preferences;
    - preparing statistics which help to get to know the User's preferences and behaviours; the analysis of these statistics is anonymous and enables the adaptation of content and appearance of the Website to the ongoing trends; statistics are also used to assess the Website's popularity;
    - possibility to log into the Website;
    - keeping the User logged in at each consecutive webpage of the Website.
  3. On the Website, the following types of cookie files are used: session and persistent cookies. Session files are temporary and stored until the User leaves the Website (by entering a different website, logging out or closing the browser). Persistent files are stored on the User's end device until they are deleted by the User or upon the expiration of the time specified in their settings.
  4. The User's Internet browser usually enables the storage of cookie files on the User's end device by default. The User can change the settings in this respect.
  5. The Internet browser also enables the User to delete cookie files. It is also possible to automatically block cookie files. Detailed information is contained in the help or documentation of the used Internet browser.
  6. Storing and accessing information does not cause configuration changes in the User's telecommunication end device and in the software installed on the device.
  7. Using the Service is possible if the User's ICT system fulfils the following minimum technical requirements:
      1. using one of the selected browsers: Chrome (version 34+), Firefox (version 38+), Internet Explorer (version 8.0+).
      2. access to the Internet;
      3. cookie files accepted by the browser;
      4. pop-up windows enabled;
      5. using Microsoft Windows XP or higher, Linux, OSX 10.4 or higher.


  1. Conditions for the provision of service
    1. Agreement with the User is concluded for a specified period of time – until the order is completed (one-time provision). The User should acquaint themselves with these Terms and Conditions before placing the order.
    2. The User is obliged to abide by the provisions of the Terms and Conditions and to refrain from any activities which may disturb the normal functioning of the Shop, in particular by using specific software and devices.
    3. The User is also obliged to use the Shop in line with social and ethical norms and the provisions of the generally applicable law.
    4. The Service Provider is obliged to complete the provision without faults and bears responsibility for any faults in the provision, in particular with regard to physical or legal faults.
    5. User should read the information on the tab or label placed on the Product or On-Demand Product and is obliged to abide by it.


  1. Withdrawal from the agreement
  1. The User can withdraw from the agreement covering Products without specifying a reason within 14 days from receiving the order.
  2. In order to withdraw from the agreement, the User should, within the indicated deadline, inform the Service Provider about it via e-mail (kontakt@notwet.pl) or traditional mail to: NOT WET, ul. Mokotowska 15a/1b, 00-640 Warsaw (the postmark date and date of contact with the Service Provider determine whether the deadline has expired).
  3. In order to withdraw from the agreement, the User can use the template of the withdrawal from agreement form, but it is not obligatory.
  4. If the User withdraws from the agreement, they bear the cost of returning the Product.
  5. If the User withdraws from the agreement, they are obliged to return the product. The return should occur not later than within 14 days from the day the withdrawal from agreement is declared.
  6. The User bears responsibility for diminishing the value of Products being part of the order as a result of using them beyond the necessary ways needed to declare the character, features and functioning of the item.
  7. Service Provider may withhold reimbursement until the Product is returned or a proof of its return is presented, depending on which event occurs earlier.
  8. In accordance with Art. 38 item 3 of Act on Consumer Rights of 30 May 2014, the User, who is a Consumer, does not have the right to withdraw from the agreement in which the object of performance of agreement is a non-pre-fabricated item, produced in accordance with the customer's specification or intended to satisfy a consumer’s individual needs. As a consequence, the User does not have the right to withdraw from the agreement, resulting from the Act on Consumer Rights, in regard to On-Demand Products.
  9. If the need to reimburse the transaction paid for by the customer using a payment card arises, the seller will reimburse it to the bank account assigned to the ordering party's payment card.


  1. Complaint procedure:
    1. Complaints can be filed by the User via e-mail at kontakt@notwet.pl or using a contact form on the Shop's Website.
    2. Service Provider will process the claim and inform the User about it promptly, not later than within 14 days from receiving it.
    3. In order to be processed as quickly as possible, the claim should include a description of the reason for claim and data enabling the identification of the User (order number from the Shop as well as User's first and last name).
    4. The provisions above do not exclude the possibility for the User to seek to exercise rights resulting from the applicable legal provisions.
    5. The User, who is a Consumer, has the possibility to use out-of-court claims processing methods and claim pursuing methods in accordance with the rules indicated at www.uokik.gov.pl under the tab "Resolution of consumer disputes" and the On-line Dispute Resolution platform, available at http://ec.europa.eu/consumers/odr/, in accordance with the Regulation No. 524/2013 of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC (Regulation on consumer ODR).


  1. Personal Data Protection
    1. The User's personal data are processed by NOT WET Karolina Szewczykowska Paulina Wajdemajer-Wyrobek S.C. with a registered office at: ul. Mokotowska 15a/1b, 00-640 Warsaw, who is an administrator of their personal data.
    2. The User's personal data is processed in order to enter into and perform an agreement, in line with the Terms and Conditions and for the purpose of direct marketing of the data administrator's products and services.
    3. Providing the data is voluntary but necessary in order to enter into an agreement.
    4. The User has the right to access and update their Data.


  1. Final provisions
    1. The Service Provider preserves the right to change these Terms and Conditions for the reasons specified below:
      1. if the change to the Terms and Conditions is necessary due to a change in generally applicable legal provisions or recognition of a provision of the Terms and Conditions as prohibited – in this scope respectively;
      2. performance of a duty resulting from a binding court verdict or a decision of administrative bodies;
      3. security reasons, including ones aimed at preventing the use of the service contrary to legal provisions or the Terms and Conditions;
      4. implementing significant changes in the functioning of the service, including changes in connection to technological or technical development, including changes to the Service Provider's systems.
    2. The Terms and Conditions covering changes implemented in accordance with the previous item will be made available to Users 30 days in advance. The implemented changes will not influence agreements concluded before the implementation of changes.  
    3. Changes to the Terms and Conditions implemented for other reasons than the ones specified in item 2 above, in particular changes concerning the introduction of new services, will not modify the content of agreements concluded with Users on the basis of the version of the Terms and Conditions in force upon entering into the agreement.
    4. In matters not covered by the Terms and Conditions, the provisions of applicable law shall apply.
    5. The agreement can only be concluded in Polish.
    6. The Terms and Conditions are in force since 08 September 2016.
